LONG TERM RESIDENTIAL SERVICE CONTRACT ("B")
AGREEMENT
made effective as of this ______ day of ____________________, 20___ ,
by and between MESS BUSTERS, INC., a corporation duly organized and
existing under the laws of the State of Florida, with a place of

PARAGRAPH I
PAYMENT
IN CONSIDERATION OF such service by MESS BUSTERS, INC., client AGREES to pay MESS BUSTERS, INC., compensation in the amount of
$___________ per service, for cleaning a ______ bedroom/studio
apartment/home for ______
hours.
(weekly, bi-weekly, monthly, bi-monthly)

If requesting additional services: + ______ hour(s) for ______________________________ .
MESS
BUSTERS, INC., will ensure that (maid’s name)
_____________________________ will perform the above services in a
competent manner for the lessor time of 1) the length of this contract
or 2) the term of his/her/their employment with MESS BUSTERS, INC.,
assuming he/she/they is/are physically capable of performing the above
services.
This AGREEMENT shall be in effect for 12 months.
However, this Agreement may be terminated by either party provided that
WRITTEN NOTICE by Certified Mail, Return Receipt, is given no later
than 60 days in advance of termination.
It is further AGREED
and UNDERSTOOD, that this agreement will continue in force for another
like period upon the same terms and conditions set forth above, unless
either party gives WRITTEN NOTICE BY CERTIFIED MAIL, RETURN RECEIPT, AT
LEAST 60 DAYS IN ADVANCE of the expiration of this Agreement. If
neither party hereto gives written notice to the other party prior to
the date of expiration then the Agreement shall automatically continue
from year to year thereafter. Failure to strictly comply with the
cancellation notice will result in the continuation of the contract
whether services were actually rendered or not.
The above correctly state our understanding of all phases of the above contract and is agreeable to each of the parties.
Payment
may be made by Personal Check, Credit Card or Cash for services
rendered. Checks are to be made payable to MESS BUSTERS, INC. Checks
may be mailed to the postal address at P.O. BOX 398926, Miami Beach,
Florida 33239-8926. Returned checks will result in an additional charge
of $25.00. Credit Card numbers must be taken over the phone for
verification. Credit Card charges may not be charged back to MESS
BUSTERS,
INC. Subsequent charges are subject to change at the discretion of MESS
BUSTERS, INC.
*MESS BUSTERS, INC. MEMBERS: Payment is due by
or before the 1st of the month or regular rates apply. This is a note
to inform you that payment received after the 7th of each month will be
charged a $25.00 late fee.
. We reserve the right to terminate services if we feel threatened or uncomfortable.
. We reserve the right to discontinue service if payments are not met.
. Workers don't handle or discuss rates on the job, please contact Mess Busters, Inc., with any questions.
Refunds can not be given, all purchases are final. MESS BUSTERS, INC., will make every effort to satisfy our clients.
REFUNDS
WILL NOT BE GIVEN IF OUR CLEANING PERSONNEL CANNOT GAIN ACCESS TO YOUR
HOME. IT IS YOUR RESPONSIBILITY TO SEE THAT WE GAIN ENTRY AND SAFE
ACCESS TO YOUR RESIDENCE TO PROVIDE SERVICE. THIS INCLUDES THE PROPER
RESTRAINT OF PETS.
If it is necessary to cancel/skip your
regular cleaning day, Mess Busters merely requires a 48-hour written
notice. If Mess Busters receives less than a 48-hour written notice, or
can not gain access to your home, it will be necessary for us to charge
the full price of your cleaning.
PARAGRAPH II
ACCESS TO HOME
Clients have the following options for allowing our cleaning people access to their home. Other options are not acceptable.
· The client will be at home when the housekeeper arrives.
· Leave the key with a neighbor and notify MESS BUSTERS of the arrangements.
· Leave the key with a doorman in the building.
· Leave a spare key on file at the MESS BUSTERS’ office key safe.
PARAGRAPH III
COVENANT NOT TO COMPETE
By
signing this document, I agree to the listed policies and agree to
refrain from employing any MESS BUSTERS’ housekeepers DIRECTLY during
the contract period and for 2 YEARS following the termination of this
agreement. I agree that if I privately employ any MESS BUSTERS, INC.,
independent contractor I shall be liable to MESS BUSTERS, INC., in the
amount of ONE YEARS SALARY for that independent contractor. This
stipulation has strong grounds based upon Florida Case law and CAN and
WILL be enforced. It is further understood that MESS BUSTERS’ workers
are independent contractors and have no authority to alter any terms of
this contract or to contact clients on behalf of MESS BUSTERS, INC.
PARAGRAPH IV
ATTORNEY’S FEES and COSTS
In
the event a dispute arises between the parties under this Agreement and
suit is instituted, the prevailing party shall be entitled to recover
his costs and attorney’s fees from the non-prevailing party. As used
herein, costs and attorney’s fees include any costs and attorney’s fees
in any appellate proceeding.
PARAGRAPH V
CLAIMS
Our
cleaning professionals , the client and Mess Busters, Inc. are covered
by MESS BUSTERS, INC., insurance policy only when they are in your home.
Claims must be filed with MESS BUSTERS, INC., within five (5) days of
the service rendered. ALL CLAIMS MUST BE FILED IN WRITING WITH MESS
BUSTERS.
Mess Busters, Inc. carries property damage and bodily injury insurance.
MESS BUSTERS, INC., IS FULLY BONDED.
PARAGRAPH VI
EQUIPMENT AND SUPPLIES
The client shall furnish all necessary cleaning supplies in order to do a complete and thorough job.
PARAGRAPH VII
FINAL PAYMENT
By signing this contract the client agrees to make the final payment on time as stated in their individual contract. If Mess Busters, Inc., does not receive the final payment on time (on the first of the month), we reserve the right to stop sending the cleaning personnel to the client's home. The client will remain responsible for payment of the entirety of the contract and be responsible for all late fees even though service is stopped for failure of payment.
By submitting this contract and entering my name and date below, I hereby indicate that I have read the FAQ's section so there are no misunderstandings or assumptions made by either party.
